Assembly passes Uniform Civil Code bill Assembly session adjourned sine die after two days of discussion on UCC bill Thursday, 08 FEBRUARY 2024 | my uttarakhand news | DEHRADUN After an intense two-day long debate on different aspects and provisions of the Uniform Civil Code (UCC), the Uttarakhand Vidhan Sabha passed the UCC bill on Wednesday. The BJP MLAs shouted slogans of Vande Matram and Jai Shri Ram as the Assembly created history by becoming the first Assembly in the country to pass a bill on UCC. After the passage of the bill the speaker Ritu Khanduri adjourned the house sine die. Since UCC is in the concurrent list of the constitution, the UCC bill passed by the Uttarakhand Assembly will now go to the President of India for approval. The UCC bill was presented in the Assembly on Tuesday by the chief minister Pushkar Singh Dhami.   Ahead of the Assembly elections of 2022 the BJP government headed by Pushkar Singh Dhami had made a promise to implement UCC in the State. In its first cabinet meeting after the victory in the elections the BJP government set up a five member committee headed by justice (retd) Ranjana Prakash Desai. The committee submitted its report on February 2 to the CM and the State government lost no time in giving constitutional validity to the UCC by convening the session of the assembly from February 5.  The UCC bill mandates similar laws of marriage, divorce, maintenance and succession in all the religions and communities in the State. The scheduled tribes have been kept out of purview of the bill. The UCC endeavours to put amend on the social evils such as child marriage, polygamy and Talaq and will protect the rights of the children and women.  The UCC will make the registration of marriage compulsory and bans second marriage of individuals in case of survival of either husband or wife. The minimum age of marriage for men and women will be 21 and 18 years respectively and will be applicable on all the religions. The rules and procedures of taking divorce will be similar in all religions and in case of any dispute between couples the woman will have the right of custody of children upto age of five years. The practice of Halala and Iddat prevalent in Muslims will be banned. One of the key features of the UCC is that it has made no discrimination between legitimate and illegitimate children. In case of the death of any person his wife and children will have equal right in his property. Similarly his parents will have rights in his property. Registration of live-in relationships has been mandatory in the UCC and their children will get all the rights.
